Immigration and Citizenship Law, 2nd Edition by John Stanley

Immigration and Citizenship Law

The definitive guide to Irish immigration and citizenship law

The new edition of Immigration and Citizenship Law provides the practitioner, student and policymaker alike with a comprehensive and definitive analysis of Irish immigration law, EU free movement of persons law in Ireland, and Irish citizenship law. It provides extensive commentary on all these interconnected areas of law, including on all legislative and policy developments and on the most recent case law from Ireland, the Court of Justice of the European Union, and the European Court of Human Rights.

The text is fully updated to reflect all legislative developments since the first edition, including amendments to the Immigration Act 2004 and the Irish Nationality and Citizenship Act 1956, and secondary law including regulations giving effect to the EU Reception Conditions Directive and the Dublin Regulation.

The new edition also provides full context for key policy developments, including 2022's Undocumented Migrants Scheme, and changes to visa and residence administrative schemes and arrangements. A new section analyses and explains developments impacting migrants resident in the state for employment reasons.

New to this Edition

  • Analyses all important new cases relating to immigration, including key judgments on constitutional family life rights in immigration-related matters (Gorry v Minister for Justice; Middelkamp v Minister for Justice); Article 8 ECHR family and private life considerations in immigration matters (MK (Albania) v Minister for Justice); the right to fair procedures in free movement-related decision-making (ZK v Minister for Justice); and unconstitutionality of naturalised Irish citizenship revocation procedures (Damache v Minister for Justice).
  • All chapters have been revised and rewritten to incorporate recent legislative and case law developments, and to cover issues and topics that have emerged or expanded since the first edition.
  • A new section has been added on employment-related residence permissions.
  • Revises and updates the content on administrative immigration schemes and arrangements.
