Building Contract and CONSULTANCY Agreement for a Home
Owner/Occupier (HO/C) and (HO/CA)

If you have hired a consultant who will deal directly with the builder on your behalf, this pack of contracts is for you.

If the consultant won't be dealing directly builder on your behalf, the building contract in this folder will not be suitable.

In this case you will need the JCT Home Owner Building Contract (HO/B) and can hire the consultant separately as your adviser.

The pack includes two separate contracts:

  • A Building Contract for when you have hired a consultant to oversee the work and deal with the builder on your behalf
  • A consultancy Agreement to use  if you have hired a consultant to provide consultancy services in relation to building work.

TEMPLATE ENQUIRY LETTER TO SEND TO CONTRACTORS

The Building Contract includes a separate Enquiry Letter template for you to use when contacting potential contractors.

Simply fill in the details and pass to your potential contractors as a starting point to arrange talks on the works you have planned.

PERMITTED USE OF JCT HOME OWNER CONTRACTS – PLEASE NOTE

  • You can only use the contract once, one contract per contractor
  • Only the purchaser can use the contract, you may not give the contract to anyone else to use for their project
  • If you want to show the contractor the contract before finalising you can save and print draft versions of the contract.
  • Fill in your name and address and that of your builder on page 2 of the contract. You will then need to check the box on page 6 that you are using the contract for one project, save the file and click the Print Draft button
  • You may not remove, change or obscure any product identification or notices of proprietary rights and restrictions.
  • You may not remove, change or obscure the contact identifiers on a contract.
  • The Home Owner Contracts are not suitable for use in Scotland.
